JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-07-2020 Heard learned counsel, Sri Ranjan Kumar Singh, appearing for petitioner, as well as learned Additional Public Prosecutor, Sri Ram Sewak Chaudhary, appearing for State, through video conferencing.
Petitioner is in jail custody since 14.11.2019 in Chhatapur P.S. Case No. 288 of 2019 registered under Sections 341, 323, 420, 386, 413, 504, 506 and 120B of the Indian penal code.
Perusal of first information report goes to show that the petitioner was driver of vehicle bearing registration number WB06-0132 and he came with his vehicle at the direction of coaccused Sahwaz Alam. The perusal of first information report goes to show that the entire allegation of cheating centres around co-accused Sahwaz Alam and others.
Patna High Court CR. MISC. No.20317 of 2020(2) dt.17-07-2020 2/2 Learned counsel of the petitioner submits that coaccused Sahwaz Alam has already been granted privilege of bail vide Cr. Misc. No. 11727 of 2020 by a coordinate Bench of this Court. He, further, points out that the petitioner does not have any criminal antecedent, which is evident from perusal of paragraph 3 of the petition.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Supaul, in connection with Chhatapur P.S. Case No. 288/2019.
