JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/354/307/34 of the Indian Penal Code.
The basic accusation is of assault to the informant and his wife.
It is submitted by learned counsel for the petitioner that the injury of the informant has been found to be simple superficial of marginal size whereas there is counter version of the occurrence and the petitioner's side also received injury. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or
Patna High Court Cr.Misc. No.15076 of 2015 (2) dt.13-05-2015 2/2 surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jehanabad in connection with Kurtha P.S. Case No.7 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
