JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2017 Earlier prayer for bail of the petitioner was rejected by this Court in Cr.Misc.No.9044 of 2017, vide order dated 28.2.2017 with an observation that petitioner may renew his prayer for bail before the court below after completion of six months period in custody.

It has been submitted by learned counsel for the petitioner that after completion of period of six months in custody he has moved before the court below and prayer for bail has been rejected and the petitioner is in custody for eight months, as such, this application has been filed for grant of bail. Heard learned counsel for the petitioner and learned APP for the State.

Having heard both sides and considering the aforesaid

Patna High Court Cr.Misc. No.39648 of 2017 (2) dt.23-08-2017 2/2 facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Gaya, in connection with Magadh University P.S.Case No. 101 of 2016, subject to the condition that one of the bailors shall be a local person having sufficient properties within the jurisdiction of court concerned and he will co-operate in trial and appear on each and every date fixed in the case and on failure to appear without any genuine reason and without permission of court, his bail bond shall be cancelled.
