The petitioner seeks regular bail in connection with Kumarkhand (Belari O.P.) P.S. Case No. 220 of 2017 for the offences punishable under Sections 461 & 379 of the Indian Penal Code.

The allegation is regarding theft having been committed by unknown accused persons and the name of the petitioner has transpired in the present case upon confessional statement made by a co-accused, namely, Md. Mintu. The learned counsel for the petitioner submits that neither any recovery has been made from the petitioner herein nor T.I. Parade has been held so as to connect the petitioner in the alleged crime. It is further submitted that the co-accused, on

No.15337 of 2019(2) dt.12-03-2019 2/2 whose confessional statement the name of the petitioner has transpired, has already been granted bail by an order dated 13.06.2018 passed in Cr. Misc. No. 32468 of 2018. It is submitted that though the petitioner is accused in two other cases, but he is on bail in the said two cases and the petitioner is stated to be remanded in the present case from that case on 13.12.2018 and since then he is languishing in custody. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhepura in connection with Kumarkhand (Belari O.P.) P.S. Case No. 220 of 2017.
