JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the State. Petitioner is an accused in Jakkanpur P.S. Case No. 252 of 2017 for an offence under section 20/22 of N.D.P.S. Act. In para-3 there is statement on affidavit that the petitioner has got no criminal antecedent.
Counsel for the petitioner submits that nothing was recovered from the possession of the petitioner and only 110 grams of Ganja was recovered from the possession of another person and on the basis of his confessional statement, the petitioner has been involved in this case.
The petitioner is in custody since 7.8.2017.
Having regard to the facts and circumstances mentioned above, let the petitioner, named above, be released on
Patna High Court Cr.Misc. No.44039 of 2017 (2) dt.19-09-2017 2/2 bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Patna NDPS Act in connection with Special Case No. 114 of 2017 arising out of Jakkanpur P.S.
