JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Phulparas P.S. Case No. 144 of 2017 dated 29.05.2017 instituted for the offences under Sections 147, 148, 149, 323, 324, 307, 353, 332, 333, 427 of the Indian Penal Code and Section 3 of the Prevention of Damage to Public Property Act, 1984.

The police party was attacked by hard and blunt substance by one Sunil Yadav and his gang. Some of the police officials are stated to have been injured. The allegation of assault and of leading the mob is against Sunil Yadav and Birendra Yadav.

Though the petitioner has been named in the F.I.R but nothing specific has been alleged against him. During the

Patna High Court Cr.Misc. No.33801 of 2018 (2) dt.05-07-2018 2/2 course of investigation, the witnesses have not taken the name of the petitioner. One of the co-accused persons of this case with similar allegation has been granted bail by the learned Court below.

Considering the aforesaid facts as also taking into account that the petitioner does not have any criminal antecedent, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Madhubani in connection with Phulparas P.S. Case No. 144 of 2017(G.R. No. 830 of 2017), subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
