2. The petitioner is in custody in connection with Bikram P.S Case No. 477 of 2023 registered for the offences punishable under Sections 341, 323, 307, 326, 34 of the Indian Penal Code.

3. As per prosecution case, allegation against this petitioner is that he along with other co-accused persons assaulted the informant and his family members by means of lathi, danda causing injury to them.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that there is land dispute between both the parties.

No.15245 of 2025(4) dt.15-05-2025 2/3 Similarly situated co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 10.01.2025 passed in Cr. Misc. No. 55606 of 2024. It is also submitted that petitioner is in judicial custody since 25.01.2025.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner and submits that petitioner bears seven criminal antecedents.

On perusal of the FIR and impugned order, it appears that the allegation against the present petitioner (Raj Kumar @ Raj Kumar Singh @ Chhote Singh is of assault by illegal arms upon the head of the informant and his hand causing serious injury. It also appears that three persons are injured, first Vinod Pandey, son of the informant Nandlal Pandey two injuries found, lacerated wound over frontal region and lacerated would over parietal region. Second Nandlal Pandey (informant) two injuries are found, first lacerated would over frontal region of head and tenderness all over the body, third injured Subodh Kumar, lacerated would over perital region and lacerated would over parietal region. It also appears from the order of Hon'ble Apex Court passed in SLP Cr. No. 14760 of 2024 dated 24.10.2024, Hon'ble Apex Court rejected

No.15245 of 2025(4) dt.15-05-2025 3/3 the anticipatory bail of the petitioner and directed to surrender before the concerned court below within four weeks and application will be considered its own merit expeditiously but the petitioner has not surrendered within the stipulated period by the direction of Hon'ble Apex Court and petitioner has surrendered before the learned trial court after 65 days.

7. Considering the facts and circumstances of the case and violation of direction of Hon'ble Apex Court, criminal antecedents of seven cases as stated in Para 3 of the petition, I am not inclined to grant regular bail to the petitioner.

8. Accordingly, prayer for regular bail of the petitioner is hereby rejected.
