JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

65 bags of rice were seized loaded on a tractor parked in front of the PDS dealership of the petitioner suspected to be carried from the PDS dealership of the petitioner for blackmarketing. It is submitted by learned Sr. Counsel for the petitioner that the petitioner was supplied grains on 07.12.2014 and it was distributed much prior to the date of seizure. The stock register of the petitioner was verified on 28.12.2014 and the stock was found nil. Moreover, the alleged seized rice has been claimed by a private person and above all the PDS dealership licence of the

Patna High Court Cr.Misc. No.25278 of 2015 (3) dt.10-07-2015 2/2 petitioner has been cancelled.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Kaimur (Bhabhua) in connection with Kudhani P.S. Case No.1 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
