Heard learned counsel for the petitioner and learned APP for the State.

The petitioners has preferred this application for grant of regular bail in a case registered u/s 302, 120B read with 34 of the Indian Penal Code and 27 of the Arms Act. As per the prosecution case, earlier co-accused persons Rajendra Mahto, Arun Rai, Sattar Miyan, Ram Prasad Yadav and Devenand Mahto assaulted the informant's father and also threatened to kill his whole family. On 06.02.2020, all the accused persons killed the informant's brother Manjesh Kumar

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is not named in the F.I.R. and the name of the petitioner has sprung up in the confessional statement of Suman Kumar Singh and Rishu Singh. There is nothing against the petitioner except the confessional statement of the co-accused. The petitioner is in custody since 29.06.2021. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of this case as well as the period of detention, the petitioner is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 86 of 2020.

The application stands allowed.
