The petitioner seeks bail in anticipation of his arrest in connection with Kudra P.S. Case No. 73/2018 dated 03.03.2018 instituted for the offences under Sections 341, 323, 325, 307 and 34 of the Indian Penal Code.

The petitioner and others are alleged to have assaulted the informant, one Deenanath Ram and one Puja Kumari, all of whom have received injuries.

The learned counsel for the petitioner has submitted that the informant is an accused in Kudra P.S. Case No. 72/2018, which has been instituted for the murder of the father of the petitioner. It has been submitted that it becomes apparent from the aforesaid fact that the present case has only been lodged to create a

Patna High Court Cr.Misc. No.33826 of 2018 (2) dt.05-07-2018 2/2 defence in favour of the informant. The petitioner, except for the present case, has not been made accused, so far, in any case. Considering the aforesaid facts, the petitioner above named are directed to be released on bail, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Kaimur at Bhabhua in connection with Kudra P.S.
