Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the OP No. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498A, 307, 406, 323, 315 and 379 of the Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act.

Learned counsel for the petitioner submits that by order dated 28-3-2024, the case was referred for mediation but then it is submitted that petitioner appeared in the mediation proceeding but OP No. 2 for reasons best known never appeared before the learned Mediator. It is also submitted that petitioner

Patna High Court CR. MISC. No.26579 of 2021(8) dt.29-08-2024 2/2 is willing to resolve the dispute, but since OP No. 2 did not appear before the learned Mediator as such the dispute could not be resolved.

Learned counsel appearing on behalf of the OP No. 2 submits that despite his best endeavours, he could not contact the OP No. 2. It is also submitted that it appears that OP No. 2 is not interested in pursing the case.

Considering the submissions made by the learned counsel for the parties, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 260 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
