JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Buxar (S.C. and S.T.) P.S. Case No. 4 of 2014 registered for the offences punishable under Sections 341, 323, 504, 406 of the Indian Penal Code and Sections 3(1) (x) of SC/ST (Prevention of Atrocities) Act.

It is submitted that good sense has been prevailed between the parties and the case has been compromised and to that extent compromise petition has been filed in the court of Chief Judicial Magistrate. It has further been submitted that all the sections are bailable except section 406 IPC and 3 (i) (x) of the

Patna High Court Cr.Misc. No.29619 of 2014 (2) dt.13-01-2015 SC/ST (Prevention of Atrocities) Act which is not made out against the petitioners as the occurrence has taken place in the house not within the public view.

Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, the petitioners above named are directed to surrender before the court below and pray for regular bail and in that case, after considering the genuineness of the compromise petition, the petitioners shall be released on bail on execution of bail bonds to the satisfaction of the court concern on the same day.

Accordingly, this application is disposed of with the aforesaid directions.
