JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-01-2020 The prayer for anticipatory bail of the petitioner was earlier withdrawn with permission of the Court by order dated 12.10.2010 and thereafter another application was rejected on 14.12.2018.

The petitioner is alleged to have taken Rs. 50,000/- from the complainant/opposite party no. 2. Today, the learned counsel for the petitioner submits that the petitioner is ready to deposit that amount along with an additional amount of Rs. 15000/- by way of bank draft.

Taking this plea of the petitioner into account, this Court is inclined to grant anticipatory bail to him. The petitioner is directed to be released on bail

Patna High Court CR. MISC. No.30325 of 2019(7) dt.22-01-2020 2/2 on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Nawada in connection with Complaint Case No. 994 of 2009, subject to the conditions as laid down under Section 438(2) Cr.P.C., if he surrenders before the court below within a period of four weeks along with a receipt of Rs. 65,000/- from the complainant/opposite party no. 2 that he has received the aforesaid amount.

Payment to opposite party no. 2 could be made either by cash or by way of bank draft subject to the choice of the complainant/opposite party no. 2. The petition stands disposed of with the aforesaid direction.
