Petitioner apprehends his arrest in connection with Barun P.S. Case No. 91 of 2012 registered for the offence punishable under Section 409 of the Indian Penal Code. Allegedly, during inquiry it was revealed that the petitioner being Jansewak withdrew the allowances of Mukhiya and sub-Mukhiya amounting to the tune of Rs. 10,000/- through cheque no. 778952 dated 29.6.2009.
Submission is that in this case co-accused Sheo Vachan Ram has been allowed pre-arrest bail in Cr. Misc. No. 44001 of 2012 whereas another co-accused Ambika Ram has also been allowed pre-arrest bail vide Cr. Misc. No. 43777 of 2012 and the
Patna High Court Cr.Misc. No.29635 of 2014 (2) dt.13-01-2015 petitioner has already deposited the alleged amount of defalcation amounting to Rs. 10,800/-.
In the facts and circumstances stated above, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 91 of 2012, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
