Petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No. 101 of 2014 registered for the offences punishable under Sections 341, 323, 379, 386 and 504/34 of the Indian Penal Code.
Allegedly, when the informant asked for rent, coaccused Lakhan Saw and the petitioner started abusing him and further co-accused assaulted with fist and slaps and petitioner came with pistol and assaulted on right side of stomach, neck and on hand and further caused threats and demanded ransom of rupees two lacs and when the informant fell down then co-accused
Patna High Court Cr.Misc. No.29725 of 2014 (2) dt.13-01-2015 Lakhan Saw took out his mobile.
Submission is that civil dispute was fought in the court of D.C.L.R. vide Misc. Case No. 101 of 2013 filed by the informant and the same was dropped and when the petitioner filed title suit, this false case has been lodged to which the learned APP does not dispute.
Considering the entirety of the case, the petitioner above named, in case of his surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 101 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
