Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the IPC and Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner has antecedent of one case and allegation is of recovery of 565 litres of liquor from Munna Rai, 460 litres of liquor from Bittu, 425 litres of liquor from Dhanu and 50 litres of liquor from a motorcycle.

Learned counsel for the petitioner submits that no liquor was recovered from the petitioner and he is in custody since 12-1-2024. It is next submitted that similarly situated coaccused, Shivnath Mahto has been granted privilege of

Patna High Court CR. MISC. No.18166 of 2024(3) dt.17-05-2024 2/2 anticipatory bail vide order dated 25-4-2024 in Cr. Misc No. 31255 of 2024.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rivilganj P.S. Case No. 262 of 2017.
