JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is apprehending his arrest in connection with Barachatti (Mohanpur) PS case No. 55/2013 for the offence under section 304(B) of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the petitioner with the help of others killed the daughter of the informant by strangulation and threw the dead body in the nearby well and gave false information regarding missing of the deceased whereas the murder was committed for non-fulfillment of demand of dowry and the attention of informant was tried to be diverted by giving false information.
It is submitted on behalf of the petitioner that petitioner is co-villager of the husband of deceased and there is no specific
Patna High Court Cr.Misc. No.23626 of 2015 (2) dt.06-07-2015 2/2 allegation against him. It has further been submitted that the petitioner has got no criminal antecedent.
On behalf of the State, it has been submitted that petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Sherghati, Gaya in connection with Barachatti (Mohanpur) PS case No. 55/2013, subject to condition as laid down under section 438(2) of the Cr. P.C. (Sudhir Singh, J) BKS/- U T
