The petitioner apprehends his arrest in Bakhtiyarpur P.S. Case No. 281 of 2014, registered for the offences punishable under Section 406 and other Sections of the Indian Penal Code. The complainant alleged that in between 02.03.2012 to 12.03.2012 the petitioner took his ATM and withdrew Rs. 15,000/-.

It is submitted that the occurrence took place in the month of March, 2012 but the complaint petition was filed after two years of the occurrence. There is no document to show that the petitioner ever withdrew any amount from the account of the complainant.
