The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 420/ 467/468/471/120B of the Indian Penal Code.

Diary in this case was called for earlier which has since been received.

Learned counsel for the petitioner submits that though the petitioner was in no way connected with the theft of the truck in question for which Runni Saidpur P.S. Case No. 649 of 2015 had been registered, the petitioner's name has been brought in during the course of investigation on the basis of the confessional statement made before the police by one Sudhanshu Kumar who is said to have named the petitioner. He further submits that actually

Patna High Court Cr.Misc. No.18593 of 2016 (3) dt.04-07-2016 P2/2 Sudhanshu Kumar was kept in police custody for over seven days and named the petitioner in his confessional statement before the police which has got no evidentiary value and the petitioner may be extended the privilege of anticipatory bail. Considering the aforementioned facts and circumstances and on consideration of the case diary and till date no further cogent material has appeared against the petitioner, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runni Saidpur P.S. Case No. 05/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
