The petitioner has prayed for regular bail in a case instituted for the offence under Section 376 of the Indian Penal Code.

The allegation against the petitioner is of raping the informant forcibly.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to property dispute. He has committed no offence. Petitioner is the father-in-law of the victim. Petitioner is an old person, who is aged about 77 years and due to illness, he does not moved freely without stick. He submitted that the victim wants to execute sale deed in her favour but the petitioner denied the same and has

Patna High Court CR. MISC. No.17087 of 2023(2) dt.11-05-2023 2/2 been implicated in the present case. He is languishing in judicial custody since 16.05.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Darbhanga in connection with Darbhanga Mahila P.S. Case No. 29 of 2022.
