JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307 and 504/34 of the Indian Penal Code.
It is alleged that the petitioner and others assaulted the agnate of the informant namely, Umrawati Devi when the informant went to rescue, he was also assaulted by the petitioner with Farsa on head, thereafter Birbahadur Yadav came to rescue the informant then co accused Mithilesh Patel assaulted him with lathi. Injury of the informant has been found to be grievous. It is submitted by the learned counsel for the petitioner that though the injury has been found to be skin deep but erroneously the doctor has opined the same to be grievous. It is

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Barauli P.S. Case No. 172 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
