JUSTICE VIKASH JAIN ORAL ORDER 14-05-2019 The petitioner apprehends his arrest for the offences alleged under Sections 498(A) and 504 of the Indian Penal Code registered in connection with Complaint Case No. 1022 (C) of 2014.

2. None appears on behalf of the petitioner despite repeated calls. The matter was passed over yesterday when the petitioner had not appeared.

3. Learned counsel for the complainant appears and opposes the anticipatory bail petition, submitting that the petitioner is deliberately not cooperating. Reference is invited to the order dated 17.11.2017 passed in Cr. Misc. No. 3190 of 2016 wherein the petitioner along with other persons had sought quashing of the complaint and had held out that the parties have amicably settled their dispute outside the court. The petitioner had expressed his readiness to pay Rs. 5,00,000/- (Rupees five lakhs) by way of

Patna High Court CR. MISC. No.22538 of 2019(3) dt.14-05-2019 2/2 demand draft to the complainant on or before 5th December, 2017. By subsequent order dated 06.09.2018 in the said case it was noted that last chance was given to settle the dispute but the dispute could not be settled. It is stated that the petitioner has still not made any payment to the complainant despite his undertaking before the court as stated above.

4. Having heard learned counsel for the complainant and having regard to the nature of complaint and conduct of the petitioner, this Court is not inclined to grant anticipatory bail to him. The anticipatory bail petition stands dismissed. (Vikash Jain, J) BT/- U T
