2. The petitioner seeks regular bail in connection with Amnaur P.S. Case No. 313 of 2022 for the offences registered under Sections 392 of the Indian Penal Code.
3. It is alleged in the prosecution case that while informant was going to Amnour with bilty, four accused persons sitting in a car intercepted him and after closing his eyes they took away his vehicle. The accused persons left the informant near brick kiln.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. F.I.R. has been lodged against unknown. Except confessional statement, there is no material against the
Patna High Court CR. MISC. No.20574 of 2024(4) dt.28-06-2024 2/2 petitioner. No incriminating article has been recovered from possession of the petitioner. Petitioner was neither arrested on the spot nor Test Identification Parade has been conducted till date. Charge-sheet has already been submitted in this case. Petitioner has three criminal antecedents in which he is on bail. He is in judicial custody since 10.11.2023. Similarly situated coaccused, namely, Anup Kumar has been granted bail by this Court, vide order dated 24.01.2024 passed in Cr. Misc. No. 604 of 2024.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIIIth, Saran at Chapra/concerned Court in connection with Amnaur P.S. Case No. 313 of 2022. (Sunil Dutta Mishra, J) rakhi/- U T
