Petitioner is languishing in judicial custody since 24.05.2017 in connection with Dholbajja (Kadawa) P.S. Case No. 39 of 2017 registered for the offence punishable under Sections 30(a)(c) (d) and 38(i) of the Bihar State Prohibition and Excise Act, 2016.

The prosecution case, as lodged by the police personnel, is that on a secret tip-off, house of the petitioner was raided and in the house various utensils required for preparing country made liquor were recovered and 2.500 litres of country made wine was found in a jar. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and nothing has been recovered from his conscious possession. However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 4th A.D.J./ Special Judge, Excise, Bhagalpur in connection with Dholbajja (Kadawa) P.S.
