JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-36A, 504/34 & 343 of the Indian Penal Code. The informant has been recovered and her statement was recorded u/S 164 of the Cr.P.C. in which, she specifically, stated that she solemnized her marriage with the petitioner by her own sweet will as well as with consent of her father. No doubt, the victim disclosed her age as 17 years whereas; learned Magistrate assessed her age as 18 years though Medical Board found the victim between 14 to 15 years of age but considering the above-said statement of the victim as well as this aspect of the matter that the petitioner is in jail custody since 25-

No.21525 of 2016 (2) dt.20-05-2016 2/2 02-2016, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mahila P.S. Case No. 19 of 2016 (Darbhanga Mahila P.S. Case No. 19 of 2016) to the satisfaction of learned Sub Divisional Judicial Magistrate, Darbhanga.
