JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 304/2011 for the offences instituted under Sections 420 of the IPC and 138 of N.I. Act. Heard learned counsel for the petitioner and learned counsel for the State.
It is alleged that the petitioner issued six cheques in favour of the complainant which got bounced due to insufficient fund in the bank account of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that as per allegation, the cheques which were issued for Rs. 4,91, 400/-, the petitioner is ready to deposit 25% of the said
Patna High Court Cr.Misc. No.29158 of 2015 (2) dt.27-07-2015 2/2 amount in the court below which may be released in favour of the complainant.
On behalf of the State it has been submitted that the petitioner is named in the complaint case.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit 25% of Rs. 4,91,400/- in the court below which shall be released in favour of the complainant and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 304/2011, pending in the court of the learned J.M. Ist Class, Patna City, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
