JUSTICE SHIVAJI PANDEY ORAL ORDER 08-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is seeking bail in connection with Bhagwanpur P.S. Case No. 08 of 2020 registered for offences under sections 399 and 402 of the Indian Penal Code and Sections 25 (1-B), A, 26, 27, 35 of the Arms Act.
As per prosecution case, the police, on receipt of secret information, raided the house of Damodar Paswan and found 10 persons assembled there to commit a crime. The police arrested six persons including the present petitioner from the spot but, three persons managed to flee away. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.14109 of 2020(2) dt.08-06-2020 2/2 nothing incriminating has been recovered from the conscious possession of the petitioner and has also got no criminal antecedent.
The petitioner is in judicial custody since 13.1.2020.
Looking to the period of custody as also considering the entire facts and circumstances of the case as also taking into account the present situation arising out of Covid-19 outbreak, let the petitioner, above named, be released on bail on furnishing personal bail bond to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No. 08 of 2020, subject to the condition that he will report to the Bhagwanpur police station on every 7th of each month continuously for six months and, in failure to appear in the police station, the present bail, granted to the petitioner, will be treated to have been canceled.
