Petitioner apprehends arrest in connection with Samastipur (Muffasil) P.S. Case No. 07 of 2023 registered for the offence under sections 30(a) of the Bihar Prohibition and Excise Amendment Act 2022.

Learned counsel for the petitioner submits that petitoner has been falsely implicated in this case. Petitioner is neither the employee of the Indian Railway nor he has any concern with House No. 398 and Block No. 68 C of the railway colony. Nothing has been recovered from the conscious possession of this petitioner.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.16677 of 2023(2) dt.26-04-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Excise Judge 1, Samastipur in connection with Samastipur (Muffasil) P.S. Case No. 07 of 2023 subject to the conditions as laid down under section 438(2) of the code of criminal procedure.
