JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-05-2016 Heard learned counsels for the petitioners and the State. The petitioners being co-villagers of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after two years of marriage for non fulfillment of dowry demands. It is alleged against the petitioners that they participated in the cremation.

It is submitted by the learned counsel for the petitioners that the thrust of accusation is against the husband of the victim and family members of the husband of the victim. The petitioners

Patna High Court Cr.Misc. No.18773 of 2016 (2) dt.02-05-2016 2/2 have been roped in the present case simply because they participated in the cremation on the request of co villager Mithilesh Kumar.

Considering the thrust of accusation against the family members of the husband and the husband of the victim, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gaya, in connection with Paraiya P.S. Case No.13 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
