The petitioner is the wife of the opposite party, namely, Abhishek, who has filed this application for transfer of Matrimonial (Divorce) Case No. 137/2020 from the Principal Judge, Family Court, Buxar to any competent Court at Patna. It is submitted that the petitioner is a lady dependent upon her old and ailing parents at Patna. It is causing much inconvenience to her to travel to Buxar from Patna to contest the matrimonial case. However, the sole opposite party, namely, Abhishek, is presently residing at Hanuman Nagar, P.S. Patrakar Nagar in Patna.

Considering the facts of the case, the Matrimonial (Divorce) Case No. 137/2020 is directed to be transferred from the Principal Judge, Family Court, Buxar to Principal Judge, Family Court, Patna.

Patna High Court MJC No.947 of 2021(4) dt.05-07-2022 2/2 After transfer of the case in the Court of Principal Judge, Family Court, Patna, the Principal Judge, Patna, will issue notice to both the parties and, thereafter, the proceeding will continue in the Court of Principal Judge, Family Court, Patna.

A copy of the order be communicated to the District Judge, Patna for compliance of the order.

With the aforesaid observation and direction, this application is allowed.
