JUSTICE SANDEEP KUMAR ORAL ORDER 10-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Barbigha P.S. Case No. 528/2022, registered for the offence punishable under Sections 30(a), 32(ii), 41(i), 52 of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioners submits that the petitioner is innocent and has falsely been implicated in this case. Nothing incriminating material has been recovered from the conscious possession of the petitioner. Petitioner are in custody since 02.12.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against

Patna High Court CR. MISC. No.19539 of 2023(2) dt.10-05-2023 2/2 the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Excise Judge, Sheikhpura, in connection with Barbigha P.S. Case No. 528/2022.
