====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 06-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 20.1.2018 seeks bail in Dalsinghsarai PS Case No. 7 of 2018 registered under Sections 279, 304A and 302 of the IPC.
The allegation in brief is that the dead body of the petitioner's husband was found on the national highway and a case under Sections 279 and 304A IPC was instituted but later on after investigation the police submitted charge-sheet against the petitioner and that the petitioner had illicit relationship with one person namely Md. Ujala so both of them eliminated petitioner's husband. Learned Counsel for the petitioner submits that merely on the basis of confessional statement before the police the petitioner, wife of the deceased, has been implicated in this case though the marriage was solemnised 15 years back and there are three sons out of the wedlock and the post mortem report indicates that the injuries have been caused by heavy and hard blunt substance, which may be in a case of road accident.
Having considered the said facts and circumstances, the
Patna High Court Cr.Misc. No.39473 of 2018 (2) dt.06-07-2018 petitioner, namely, Najrana Khatoon is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Dalsinghsarai, Samastipur in connection with Dalsinghsarai PS Case No. 7 of 2018.
