19-08-2017 Heard Sri Sada Nand Roy, learned counsel assisted by Sri Kumar Vikramdeo Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor.

The sole petitioner, who is in custody on surrender 07-06-2017 in Kargahar P.S. Case No. 120 of 2017 registered for offence under Sections 30(a), 37(b), 48 of Bihar Prohibition and Excise Act, 2016 (for short "Excise Act"), has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been made accused in a case of recovery of about 21 litres of country-made liquor, which was found in the compound of a school and petitioner has been named as accused on statement made by chowkidar of the school. Learned counsel for the petitioner submits that since earlier in a case relating to

No.39642 of 2017 (2) dt.19-08-2017 2/2 offence under the Excise Act, petitioner was made accused, the police, though none had seen the occurrence, had falsely implicated the petitioner in the present case. Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Vijay Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II cum Special Court, Excise, Rohtas at Sasaram in connection with Kargahar P.S. Case No. 120 of 2017.
