JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in connection with Motihari Muffasil (Lakhaura) P.S. Case No. 76 of 2014 for the offences instituted under Sections 147, 148, 149, 342, 323, 324, 332, 333, 353, 427, 307, 380, 411, 452 and 506 of the IPC. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 15.03.2014, a mob of about 150 persons armed with Lathi, Farsha, Bhala etc., led by Babulal Sahani came to the police station and started pelting stones and damaged the property of police station and subsequently made an attempt to kill the police officials and in during that course two mobile phones were looted and

It has been submitted on behalf of the petitioner that no allegation has been attributed against the petitioner. Altogether 25 persons have been named in the F.I.R. It is further submitted that the petitioner has got no criminal antecedent. Other co-accused have been granted bail vide Cr. Misc. Nos. 31470 of 2014, 31737 of 2014, 32324 of 2014 and 38239 of 2014.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Motihari Muffasil (Lakhaura) P.S. Case No. 76 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sadar at Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
