JUSTICE MADHURESH PRASAD ORAL ORDER 25-06-2019 This writ petition has been filed claiming relief for consideration in the matter of appointment pursuant to Advertisement No. 3 of 2010 issued by the Establishment Section of Patna Collectorate.
Counsel for the State submits that the petitioner has not applied in response to the same and as such the relief claimed in the writ petition is not maintainable. Counsel for the petitioner disputes the submissions advanced by the State Counsel. He submits that the respondents have not placed anything on record to show that the petitioner has not applied pursuant to Advertisement No. 3 of 2010.
Patna High Court CWJC No.7758 of 2015(3) dt.25-06-2019 2/2 Calling upon the respondents to prove the negative would not be appropriate. The petitioner has not placed on record any receipt in support of his claim of submission of application.
In view of the aforesaid situation, this Court is not inclined to exercise jurisdiction in favour of the petitioner. The writ petition is devoid of merit and the same is dismissed.
