It has been submitted by learned counsel for the petitioner that petitioner has been granted the privilege of anticipatory bail vide order dated 06.07.2018 passed in Cr. Misc. No. 38460 of 2018 but inadvertently at the time of hearing of the case, learned counsel for the petitioner inadvertently could not mention about the fact that the petitioner has earlier also moved for grant of anticipatory bail, which was rejected vide order dated 19.01.2018 passed in Cr. Misc. No. 58832/2017. In view of the submission of learned counsel for the petitioner, order dated 06.07.2018 passed in Cr. Misc. No. 38460
Patna High Court Cr.Misc. No.38460 of 2018 (3) dt.11-07-2018 2/2 of 2018 is rescinded and the petitioner is directed to surrender before the court below within a period of six weeks and pray for regular bail and if any such application is filed the court below shall decide the same on the basis of materials available on record and shall pass an appropriate order, if possible on same day. Let a copy of this order be communicated to the concerned court below forthwith.
