This is an application for anticipatory bail for the offence punishable under sections 302 and 34 of the I.P.C. Allegedly the daughter of the informant was poisoned to death and she was married five years ago with one Ranglal Ram, son of petitioner no.1 and it is alleged that the petitioners, husband and other co-accused used to assault her as she was issueless.

Submission is that the informant after knowing the truth in his statement recorded under section 164 Cr.P.C. has not stated any overtact alleged to be committed against her. His daughter consumed poison herself and as such these petitioners

Patna High Court Cr.Misc. No.29763 of 2014 (2) dt.15-01-2015 2/2 who are mother-in-law and unmarried Nanad deserve sympathetic consideration as husband of the deceased is already in custody and father-in-law has been granted bail by this Hon'ble Court. The learned A.P.P. after going through the statement recorded under section 164 Cr.P.C. fairly submits that now the informant is not supporting the F.I.R. as it appears that the matter has been compromised vide Annexure-3.

In the facts and circumstances as stated above, the petitioners, namely, Guljari Devi and Sangita Kumari in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M. Motihari, East Champaran in Gobindganj P.S. Case No. 19 of 2013, subject to the conditions as laid down in section 438 (2) of the Cr.P.c.
