The learned trial court vide letter no. 42, dated 10.06.2019, has reported that except one charge-sheeted witness almost all the proposed prosecution witnesses have already been examined.

The petitioner happens to be assailant. Although, it is pointed out that the petitioner is in jail custody for near about five years but considering the nature of allegation as well as stage of his trial, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Session Trial No. 313 of 2015 arising out of Goraul P. S. Case No. 131 of 2014 stands rejected.

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as

Patna High Court CR. MISC. No.15329 of 2019(3) dt.03-07-2019 2/2 possible, preferably within six months. It is also made clear that if trial court fails to conclude the trial of the petitioner within the aforesaid period of six months without any fault of the petitioner, the petitioner may renew his prayer for bail before the learned trial court itself.
