2. In the instant petition, petitioner has prayed for following relief:- "1. That, this is an application for issuance of any appropriate writ/writs order/orders or direction/directions, commanding the Respondent authorities to appoint the petitioner on the post of Anganbari Sevika of Anchal-Shahpur Gram Panchayat-Lahang Dumaria, Ward No. 11, Police Station- Bihiya, District- Bhojpur on the place of Private Respondent No. 6 (Anjula
Patna High Court CWJC No.5921 of 2020 dt.13-12-2021 2/2 Kumari) who is illegally appointed of aforesaid post because Respondent No. 6 residing in Ward No. 10 house No. 71 of aforesaid Gram Panchayat."
3. Perusal of the records, it is evident that the petitioner has not questioned the validity of 6th respondent's appointment to the post of Anganwari Sevika of AnchalShahpur Gram Panchayat-Lahang Dumaria, Ward No. 11, P.S.- Bihiya, District-Bhojpur.
4. That apart, petitioner has statutory remedy of appeal against the appointment of 6th Respondent to the aforesaid post. Thus, petitioner has not made out a case. Petitioner is at liberty to prefer appeal against the order of appointment issued in favour of 6th Respondent before the appellate authority. If such appeal is filed within a period of eight weeks from the date of receipt of this order, the appellate authority is hereby directed to consider and dispose of the petitioner's appeal within a period of three months from the date of receipt of memo of appeal.
5. With the above observations, the instant petition stands disposed of.
