JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.
The petitioners, apprehending their arrest in connection with Complaint Case No. 1327C of 2010 registered for the offences punishable under Section 498A of the Indian Penal Code and under Section 4 of Dowry Prohibition Act, seek the privilege of pre-arrest bail.
It is submitted that in this case, the husband and wife have compromised the case and the husband is paying the amount of maintenance per month to his wife and, accordingly, the husband has been allowed bail by the court below itself and as
Patna High Court Cr.Misc. No.29728 of 2014 (3) dt.22-01-2015 such, the petitioners being the relatives of the husband also deserve sympathetic consideration.
As submitted, the petitioners are directed to surrender in the court below within two months from the date of receipt/production of a copy of this order and seek regular bail and the court below after ascertaining that the husband is on bail shall release the petitioners also on bail on the same date on execution of bail bonds to its own satisfaction.
Let this order be sent through Fax at the cost of the petitioners in connection with Complaint Case No. 1327C of 2010 pending in the court of learned Sub-Divisional Judicial Magistrate, Saharsa.
