This is an application for bail in connection with Akorhigola P.S. Case No. 115 of 2017 registered for the offences punishable under Sections 414/34 of the Indian Penal Code. Allegation as per FIR is that police raided and apprehended the petitioner and one co-accused, who were on motorcycle and on being asked they could not produce the paper of vehicle as motorcycle was stolen one.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is employee of the co-accused, as such, he was traveling with him in motorcycle. Further submission is that there is nothing on record to show that motorcycle was stolen one and he is in custody for more than two

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. However, petitioner may renew his prayer for bail once charge has been framed in this case.
