The petitioner, in the present case, is seeking regular bail in connection with K. Hat P.S. Case No. 469 of 2017, registered for offences alleged under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the name of the petitioner has brought in the present case only on the basis of the confessional statement of the co-accused. It is submitted that the there is no recovery of any stolen property from the possession of the petitioner and the fact is that the petitioner has been falsely implicated in one case after another by police without there being any evidence against him. Learned counsel submits that prior to the present case there was only one case against the petitioner but
Patna High Court Cr.Misc. No.37346 of 2018 (2) dt.28-06-2018 now in two more cases he has been taken on remand. Learned APP for the State is present.
Considering the facts and circumstances of the case whereunder the petitioner is said to have been involved in the confessional statement of the co-accused and that there is no recovery from his possession as also that no TIP has been conducted so far, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K.Hat P.S. Case No. 469 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
