JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners, apprehending their arrest in connection with Koransarai P.S. Case No. 34 of 2014 registered for the offences punishable under Sections 323, 341, 504, 354 and 448 of the Indian Penal Code, seek the privilege of pre-arrest bail. At the very outset, it has been submitted that in this case both the parties have compromised the case and to that extent compromise petition is also filed in the learned court below. No offence as alleged is made out and as such, the petitioners deserve sympathetic consideration.

The learned A.P.P. on the other hand submits that in

Patna High Court Cr.Misc. No.29604 of 2014 (2) dt.12-01-2015 view of compromise, lenient view can be taken. In the facts and circumstances as stated above, the petitioners are directed to surrender in the learned court below with compromise petition and the learned court below after examining the genuineness of the compromise shall release the petitioners on bail on execution of bail bonds to its satisfaction. Accordingly, this Anticipatory Bail Application is hereby disposed of.
