====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-03-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 414 and 34 of the Indian Penal Code, registered in connection with Karjain P.S.Case No.162 of 2020.

The learned counsel for the petitioner has submitted that he has previous enmity with Md. Rizwan. It is because his name has been uttered by co-accused Md. Rizwan, but in this respect there is no evidence.

Patna High Court CR. MISC. No.26651 of 2021(2) dt.07-03-2022 2/2 Co-accused Md. Rizwan was chased and apprehended at the spot, whereas the petitioner became successful in fleeing away. One stolen motor-cycle was recovered from the house of of co-accused Md. Rizwan, who disclosed the name of the present petitioner in his confessional statement. The petitioner has also two criminal antecedents of similar nature of the case. Considering the above-mentioned facts facts and circumstances, it is not a fit case for anticipatory bail. The prayer on behalf of the petition for anticipatory bail is hereby rejected.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
