This is an application for quashing of the order dated 27.2.2015 passed in Complaint Case No. 1245 C of 2013 by the learned Judicial Magistrate, 1st Class, Khagaria whereby cognizance was taken under Section 417 of the Indian Penal Code.

As per the complaint, the accused 'Sarpanch' illegally took Rs. 10,000/- each from 50 persons of his village after informing them that they have been made accuseds in the case and further promised that he would ensure that their names are off the list of accused persons. Further, he took Rs. 20,000/- in the name of two sons of witness No. 2 and similarly he had

Certainly, this is not a fit case in which any interference is required.

However, in view of the fact that no one has appeared on call, dismissed for non-prosecution giving liberty to raise all the points before an appropriate Court at an appropriate stage. (Rajiv Roy, J) Ajay Singh/- U T
