====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-04-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under section 30a of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 6 liters illicit liquor was recovered from a car and motorcycle was also recovered from the spot of which petitioner is the registered owner.
4. Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case on suspicion. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused.
5. Learned counsel for the State opposes the prayer for bail. He submits that petitioner is the owner of the
Patna High Court CR. MISC. No.15477 of 2025(2) dt.07-04-2025 2/2 motorcycle which was recovered from the spot and petitioner managed to escape.
6. Considering the aforesaid facts, prayer for bail of the petitioner is refused.
