JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 341, 323, 307, 379 and 504 of the Indian Penal Code.

The prosecution case is that the petitioner assaulted with iron rod on the head of the informant whereas co-accused Nuzarat Khatoon assaulted on the wrist of the informant when other accused snatched jewellery.

It is submitted by learned counsel for the petitioner that the injury report of the informant is not on record as gets reflected from the impugned order and for the occurrence of 01.04.2015 the FIR was registered on 11.04.2015. There is no accusation of repeating blow.

It is submitted by learned counsel for the informant that

Patna High Court Cr.Misc. No.23674 of 2015 (2) dt.07-07-2015 2/2 the informant has received grievous injury.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Barsoi P.S. Case No. 52 of 2015 pending in the court of learned CJM, Katihar. Accordingly, the application is disposed of.
