The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379, 384, 504 and 506/34 of the Indian Penal Code. The prosecution case, in brief, is that while the informant was sitting at the shop of stand and stone, the petitioner along with other three unknown persons, armed with weapon, came and started assaulting due to which the informant sustained head injury. It is further alleged that when the informant's wife and family members came for his rescue, they also assaulted them and took away running Rs. 25,000/- which has been kept in a box at the shop.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

There is no specific allegation of assaulting against the petitioner. He has got no criminal antecedent. Moreover, the petitioner is languishing in judicial custody since 11.10.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bakhri P.S. Case No. 318 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Begusarai.
