The petitioner seeks bail in a case registered for offences under Sections 420/34 of the Indian Penal Code and Sections 30 (A), 37(d), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
It is contended that there is no recovery from the possession of the petitioner, however, on the basis of statement of co-accused he has been named in the First Information Report. It is further contended that two police cases are pending against the petitioner which have nothing to do with the Excise Act and in both the cases he is on bail. It is also contended that

Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna in connection with Patliputra P.S. Case No. 71 of 2017 (G.R. No. 1545 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
