2. This Civil Miscellaneous Application has been filed for setting aside the order dated 04.02.2023 passed by the learned District Judge, Saran at Chapra in Civil Miscellaneous No. 280 of 2022 whereby and whereunder he has rejected the transfer petition filed by the petitioner to transfer Eviction Suit No. 09 of 2013 from the Court of 9th Sub-Judge, Saran at Chapra to any other appropriate Court.

3. Learned counsel for the petitioner submits that the case has already been transferred to other Court and, thus, this application became infructuous. He has further submitted that the said Eviction Suit is running for final argument since long

4. Learned counsel for the petitioner prays to dispose of the case with observation for early disposal of the suit.

5. In view of the submissions of learned counsel for the petitioner, this Civil Miscellaneous Application is disposed of.

6. The learned Court below is expected to expedite the disposal of Eviction Case No. 09 of 2013 and shall not give any unnecessary adjournment to the parties.
